Welcome to the MSH website terms and conditions. Please read through them carefully before placing your order. By using this website and/or placing an order; you agree to and are bound by, the terms and conditions set out below.
We may change these terms from time to time without notification to you. Any changes will take effect on the date they are posted on to the site.
RETURNS AND CANCELLATION
Wholesale buyers can return goods for up to 7 days after the day they receive the order and receive a full refund. However, returned items will be inspected and should be returned in the same condition as received. If there is evidence that the contents of an order have been used, then the returned items will be sent back to you. Our extended returns policy for retail and wholesale buyers extends only to goods that are damaged or faulty. MSH will cover the cost of second class postage delivery of any goods returned due to a manufacturing fault or damage. This does not apply to goods that remain unsold. We try to keep our website images up to date, however, occasionally images may not match the items which are in stock, due to changes in manufacturing processes or other changes out with our control. If you are not satisfied that the items sent are the items you have ordered, please contact us and we will look into this matter for you. If you would like to return any goods please either ring us on 0141 959 7362 or send an email to email@example.com stating your original order number and the items you wish to return and we will then get back to you to organise the return. All returned items will be refunded or credited within 30 days. All credit notes can be used within 6 months of the issue on future orders.
CANCELLATION BY US
We reserve the right to cancel the contract between us and the client if:
- We have insufficient stock to deliver the goods you have ordered
- We cannot deliver to your area
- One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by e-mail and we will re-credit your account within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
All prices shown in this website are quoted in pounds sterling. Data entry errors or other technical problems may result in inaccurate prices being shown. In such cases, we the company are not required to honour this price. If you see any price you believe to be incorrect, please contact us so we can verify it for you.
DUTIES AND LOCAL TAXES
Purchasers are responsible for any duties and/or taxes levied at the point of entry into the destination country.
DELIVERY OF GOODS
We will deliver the goods to the address provided by the customer for delivery at the time the order is placed. The purchased item will be posted as soon as possible after the order is accepted. You will become the owner of the goods you have ordered when they have been delivered to you. Risk of damage to or loss of the goods shall pass to you at the time of delivery. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. Please be aware that any items sent recorded at your request become the property of you once signed for from our courier. Should an inaccurate signature be given to us, the company cannot be held responsible if we have diligently sent the goods to the address given on the order form.
If the goods we deliver are not what you ordered, are damaged, defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address or by email within 7 working days of the delivery of the goods in question.
If you notify us of a problem under this condition, our only obligation will be, at your option:
- to make good any shortage or non-delivery
- to replace or repair any goods that are damaged or defective
- to refund to you the amount paid for the goods in question in whatever way we choose.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) whatsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the import or export of particular goods. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
EVENTS BEYOND OUR CONTROL
We shall have no liability to you for any failure to deliver goods you have ordered, any delay in doing so, or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control. This includes, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
THIRD PARTY RIGHTS
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
